Artificial intelligence is transforming the retail landscape, enabling retailers, marketers and brands to personalize experiences for consumers, boost engagement and optimize in-store operations. Alpha Modus Holdings Inc. (NASDAQ: AMOD), specializing in AI-driven retail and fintech solutions, has been an innovator in this evolution, developing technologies that capture consumers' sentiments during initial product interactions through sensors and AI. The company builds technology ranging from digital signage to smart inventory management systems, deploying kiosks and targeted digital ads to enhance shopping experiences.
The company has faced challenges defending its intellectual property in ongoing patent infringement lawsuits, with the first case set for trial in November 2025. Alpha Modus maintains these cases reflect its commitment to protecting technology and securing recognition of its innovations. The company's defense strengthened significantly with a patent settlement with Shelf Nine and its parent company, VSBLTY Groupe Technologies. Beyond ending litigation and validating Alpha Modus' technology claims, the parties are embarking on a planned strategic partnership.
William Alessi, CEO of Alpha Modus, stated, "In an industry where technological advancement often outpaces legal frameworks, it is crucial that companies assert their IP rights to ensure that their innovations are recognized and leveraged to propel the industry forward." He added that the settlement sets a powerful legal precedent that strengthens Alpha Modus' position in ongoing lawsuits against other major retailers and digital signage networks, demonstrating that its patents are enforceable and valuable.
While this marks the first settlement in Alpha Modus' patent infringement suits, the company hopes it won't be the last. It has claims against Walgreens Boots Alliance Inc., Wakefern Food Corp., and Brookshire Grocery Co., among others. In the Walgreens case, Alpha Modus alleges willful infringement of its patented AI-driven retail technology that enhances in-store shopping through data-driven insights, interactive advertising and consumer engagement tools, seeking $500 million in damages. The company contends that Walgreens' deployment of Cooler Screens digital smart screens mirrors innovations protected under its patents.
The settlement with VSBLTY gives Alpha Modus more confidence in pursuing further legal actions and puts potential patent infringers on notice, reinforcing its commitment to protecting proprietary technology and its investors. Jay Hutton, CEO of VSBLTY Groupe Technologies, noted the irony of the situation: "What started as a lawsuit has evolved into one of the most valuable alliances for both organizations. We now have the opportunity to compete in an industry dominated by giants, backed by a portfolio of patented IP from Alpha Modus and VSBLTY."
The proposed strategic partnership with VSBLTY, maker of digital displays, may prove game-changing. VSBLTY will integrate Alpha Modus' proprietary technology into its data analytics software, enabling smarter, more efficient and more engaging retail environments. Alessi emphasized, "Innovation thrives when protected and respected. Alpha Modus is not just protecting its patents—it is shaping the future of retail AI." With technology validated, IP portfolio strengthened and a transformative partnership developing, Alpha Modus says it is positioned for growth as a pioneer defining the future of retail AI.
